Welcome to the website of the Accountests LLC (“Accountests”, “we”, “us” and/or “our”). We have prepared this Privacy Policy (“Privacy Policy”) to explain how we collect, use, process, protect and disclose information and data when you use the Accountests website www.accountests.com and any other website hosted or maintained by Accountests (the “Site”) and all Accountests products and services offered in the United States to customers within the United States, including but not limited to the Accountests testing platform made available at www.accountests.com, Accountests printed and electronic assessment/testing reports, printed and video manuals, articles and all other products or services offered by Accountests or through third parties that provide Accountests products or services to you (collectively, the “Services”). “You” and “User” both refer to you as a user of the Site or Services.
By using the site or services you consent to this Privacy Policy. If you do not agree to the terms of this Privacy Policy, do not use the services or the site. The terms of this Privacy Policy shall not supercede any law, regulation, or written policy of Accountests that governs the use of a specific Accountests product or service, or agreement that any user of the site or services has entered into with Accountests that provides for the modification of this Privacy Policy.
1. Managing Your Information Preferences
When you establish a Accountests user account on the Site, you can review, correct, or update your Personal Information (defined below) by changing the relevant settings in your Accountests user account. You can opt out of receiving marketing emails by clicking the unsubscribe link provided in any marketing email sent by Accountests, or by emailing us directly at help@accountests.com. You cannot opt out of receiving communications that are related to the Services that you have requested or purchased from us or that have been requested or purchased by a third party for your use. 2. Information We Collect
2.1. Personal Information
For purposes of this Privacy Policy, the term “Personal Information” is used interchangeably with the term “Personal Data” and is defined to include all data about a living individual who can be identified from those data (or from those data and other information either in our possession or likely to come into our possession). The Personal Information that we collect when you sign up for or use the Site or Services or when third parties provide you with access to or use of the Services include: your name, email address, username and password, employment sector and size, all of which becomes part of your user profile information. When you or your employer create an account for you to use any of the Services, we collect the user profile information provided to us that enables us and others authorized by you to be identified through the Services. If we do not receive the profile information required to create your account, you will not be able to use all of the features of the Site or Services. We also collect Personal Information from you when you access the Site and the Services and elect to provide Personal Information. For example, when you use the Services, we will collect data that you upload to the Site and/or information that you input into your account, as well as information from third parties identified by you to enable them to provide us with Personal Information about you to facilitate your use of the Services. Such Personal Information and data that we may collect from you and third parties authorized by you to enable us to provide you with the Services may include: your street address, the services purchased, employment information and location information, We consider all of the items described in this paragraph to be private and confidential Personal Information, and Accountests will not use, process or disclose it except as necessary to provide the Services and as described in this Privacy Policy.
2.2. Usage Data, Site Activity, and Location Information
We automatically collect information regarding the actions you take on the Site and Services ("Usage Data"). Usage Data is information or content we collect about the use of our Site or Services in a way that does not identify an individual user. Usage Data help us understand trends in our users’ needs so that we can better consider new features or otherwise tailor our Services. This Privacy Policy in no way restricts or limits our collection and use of Usage Data, and we may share Usage Data about our users with third parties for various purposes, including to help us better understand our customers’ needs and improve our Services. When you use the Site or Services, some examples of the Usage Data we may collect are: the type of Web browser you use, your operating system, your web request, your Internet Service Provider, your IP address, referring/exit pages and URLs, the pages you view and how you interact with links on the Services, comments and other content you post via the Services, the time and duration of your visits to the Site or use of the Services and other such information. We may store such Usage Data itself and/or such information may be included in databases owned and maintained by Accountests affiliates, agents, or service providers. We may use such information and pool it with other information to track, for example, the total number of visitors to our Site or users of our Services, the number of visitors to each page of our Site, etc. We use this information to help us understand how people use the Site and Services, and to enhance the Site and Services. The Site and/or mobile applications utilized to access the Site on a cell phone may collect certain additional information automatically, including, but not limited to, the type of mobile device you use, your mobile device’s unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, available storage space, connection type (e.g. WiFi vs. cellular) and information about the way you use the application. We may also use GPS technology (or other similar technology) to determine your current location. If you do not want us to have your location information, you should turn off the location services for the mobile application located in your account settings or in your mobile phone settings and/or within the mobile application.
The Accountests assessment system collects data generated by users of the Services that are capable of identifying users and subjects of Accountests assessments. User interactions in Accountests’ assessment system are logged with a unique identifier which links back to a separate data file that includes Personal Information. User interaction data are linked to user Personal Information in order to generate test scores and/or assessment results. Score and results information and test taker identity data are primarily available to authorized users of the Accountests assessment system. Personal Information may be accessed by Accountests when users make inquiries for assistance related to an assessment administration, for the investigation of assessment system technical problems, for investigations of suspected or reported testing irregularities, and in order to deliver Accountests assessments.
2.3. Cookies and Web Beacons
We use cookies (a small text file placed on your computer to identify your computer and browser). We may also use Web beacons (a file placed on a website that monitors usage). We use cookies and Web beacons to improve the experience of the Site and Services, such as pre-populating your username for easier login, to allow user-specific messaging or to permit user-specific advertising. We do not use cookies or Web beacons to collect Personal Information. Most Web browsers are initially set up to accept cookies. At this time, Accountests does not recognize automated browser signals regarding tracking, including "do-not-track" signals. You can remove persistent cookies and change your privacy preferences by following directions provided in your Internet browser’s "help" directory. However, certain features of the Site or Services may not work if you delete or disable cookies. Some of our Service Providers may use their own cookies and Web beacons in connection with the services they perform on our behalf, as further explained below.
2.4. SMS / Text Messaging Communications
We may, from time to time, send you SMS (text) messages relating to specific matters involving your use of our Services or other relevant communications. By providing us with your mobile number (or any other contact information), you consent to receive such SMS messages from Accountests, subject to the terms below:
2.4.1. Purpose & Consent
- We do not intend to use SMS messaging as a tool for general marketing or lead generation.
- SMS communications will only be sent in connection with particular matters, service updates, or where we deem them helpful and relevant to your use of our Services.
- By providing us with your mobile number, you expressly consent to receive these communications.
2.4.2. Message Frequency
- The frequency of messages may vary, depending on our interactions with you and the nature of the communication.
2.4.3. Opt-Out / Help
- You may opt out of any further SMS communications at any time by replying STOP.
- For additional information or assistance, you may reply HELP to any message.
- After opting out, you will no longer receive SMS messages from us (except as may be required for legal or service-related purposes).
2.4.4. Third-Party Sharing
- Your mobile number or SMS consent information will not be shared with third parties for their marketing or promotional purposes.
- We do not exchange, sell, or otherwise distribute SMS opt-in data to external marketing partners.

3. How We Use Information and When We May Share and Disclose Information Generally
We may use your Personal Information for the purpose for which it was provided, including without limitation for the purposes described further below.
3.1. Provision and Monitoring of the Services
We will collect, use, process, store, transmit, and share your Personal Information as necessary to deliver the Services and support and monitor your use of the Services, in accordance with all applicable Accountests policies and any agreements entered with Accountests that govern the use of the Services. Some of the data we collect to provide the Services are required as account security measures and user authentication data.
3.2. Surveys and Other Special Offers
From time to time, we may offer our users the opportunity to participate in surveys and other special offers. If you elect to participate in these services, you will need to provide certain Personal Information.
3.3. Questions and Requests
If you contact us by e-mail or otherwise, we will use the personal information you provide to answer your question or resolve your problem. If you do not have a user account, we do not regard any information submitted by you as a question or request as private or confidential and will use and share such information in its sole discretion, as necessary for our business purposes.
3.4. Contacting You About Other Products, Services and Events
Accountests may use your personal information to contact you in the future to tell you about products, services, and events that may be of interest to you, unless you opt-out of receiving messages of this nature.
3.5. Research and Data Analysis
In an ongoing effort to better understand and serve the users of the site and the services, and in the service of scientific research, Accountests may conduct research on its users’ demographics, interests, and behavior based on usage data and other information provided by users and third parties. This data may be de-identified, compiled and analyzed on an aggregate basis, and Accountests may share this de-identified data with researchers, educational institutions, business partners, publications, and other third parties. This aggregate research data will not identify you or users personally.
3.6. Service Improvement
We may use your personal information, aggregated personal information, and other non-personally identifiable information collected through the site and services to help us improve the content and functionality of the site, to better understand our users, and to improve the services.
3.7. Order Fulfillment
We may use your personal information that you provide to fulfill any orders you may place for services offered by Accountests.
3.8. Investigation
We may use, process and disclose your personal information, usage data, user interaction data and other non-personally identifiable information collected through the site and services to investigate whether any use of the site and services may potentially violate any policies of Accountests, agreements between users of the services and Accountests, the rights of Accountests and any of its members or a third party, or any applicable law or regulation. This includes, but is not limited to, the investigation of allegations, reports or suspicion of conduct that could affect the validity of Accountests assessment results for one or more persons, and other activities that may violate the terms of use of the site and/or services. The findings of any such investigation may be disclosed to interested third parties, which may include, as applicable, your employer, educational institutions, and governmental authorities.
3.9. Deletion of Candidate Data (effective April 15, 2026)
Accountests will delete candidate testing data at the end of each month,12 months after a test is completed. All information (including personally identifiable information) will be permanently removed from our testing records. No candidate reports (including proctoring reports) will be able to be accessed through the Accountests platform 12 months after a test is completed.
Users must therefore save, and securely store, any candidate testing information they wish to retain, in their own platform, within 12 months of a test completion.
4. Information You Make Available to Others
By using the Site or Services, you may provide and upload and direct third parties to provide and upload Personal Information that you expressly direct us to share with designated third parties in order to participate in Services offered by us. If you direct us to share your Personal Information with designated third parties in connection with our delivery of the Services, we will do so in accordance with your consent and direction in the scope of our delivery of the Services.
4.1. Service Providers
From time to time, we may establish a business relationship with other businesses that we believe to be trustworthy and have privacy practices consistent with ours ("Service Providers"). For example, we may contract with Service Providers to provide certain services, such as hosting and maintenance, accounting, data analytics and data storage and management, assessment-related activities, Internet-based platforms, and marketing and promotions. We only provide our Service Providers with the information necessary for them to perform these services on our behalf. Each Service Provider must agree to use reasonable security procedures and practices, appropriate to the nature of the information involved, in order to protect your Personal Information from unauthorized access, use, processing or disclosure. Service Providers are prohibited from using Personal Information other than as specified by Accountests.
4.2. Advertising
We also may share non-personally identifiable information with third party ad servers, ad networks, and data exchanges ("Advertisers") so that they can tailor their advertisements to your apparent interests and deliver those advertisements to you while you are either on our Sites or use our Services. 4.3. Other Transfers

5.2. Exclusions
This Privacy Policy shall not apply to any unsolicited information you provide to Accountests through the Site or Services or through any other means. This includes, but is not limited to, information posted to any public areas of the Site, any ideas for new products or modifications to existing products, and other unsolicited submissions (collectively, "Unsolicited Information"). All Unsolicited Information shall be deemed to be non-confidential and Accountests shall be free, and you hereby grant Accountests the right, to reproduce, use, disclose, and distribute such Unsolicited Information to others without limitation or attribution.
5.3. Security
We maintain physical, technical, and organizational safeguards to protect the confidentiality and security of Personal Information and other information transmitted to us. However, no data transmission over the Internet or other network can be guaranteed to be 100% secure. Accountests is not responsible or liable for any damage or loss related to your use of any third-party website or online service. You should always read the terms and conditions and privacy policy of a third party website or online service before using it, whether directly or in connection with your use of the Site or Services. Third parties may collect, but we do not authorize them to collect, personally identifiable information about your online activities over time and across different websites when you use the Sites or Services.
5.5. Children's Privacy
Neither the Site nor the Services are intended to collect Personal Information directly from children under the age of 18. Children should not provide any Personal Information on the Site or through the Services without advance written permission from their parent, guardian, or school administration or staff serving in the capacity of “in loco parentis.” Accountests complies with the Children’s Online Privacy Protection Act (“COPPA”). The Site and the Services are always intended to be used as directed and supervised at all times by a responsible, qualified adult, following the receipt of actual consent by the child’s parent, guardian, or relevant school administration or staff. We do not share children’s Personal Information with third parties not bound by this Privacy Policy, or otherwise inconsistent with the requirements of COPPA. 6. California Privacy Rights
When California customers provide personal information to a business, they have the right to request certain disclosures if that business shares personal information with third parties for the third parties' direct marketing purposes. Once per calendar year the customer may request that the business provide a list of companies with which it shares personal information for those companies' direct marketing purposes, and a list of the categories of personal information that the business shares.
